TERMS AND CONDITIONS- Care Lactation Support

These Terms and Conditions form a client agreement between you the client (hereby referred as you, your) and CARE LACTATION SUPPORT ABN 38120097318 (also referred to as Leanne O’Connor, the Lactation Consultant).

These Terms and Conditions also include the Fee Schedule, which can be found here. You must read the Fee Schedule along with these terms and conditions.

In making a booking with CARE LACTATION SUPPORT you are accepting these Terms and Conditions and Fee Schedule.

Description of service

These Terms and Conditions relate to services provided by CARE LACTATION SUPPORT which include pre- and post-natal breastfeeding, chest feeding and lactation support and management via in person consultations, telehealth, courses, education programs and written and video media (Services).

Bookings

1. All clients with bookings will receive an appointment reminder 24 hours before their appointment time, which must be confirmed via completion of their COVID-19 screening, and for Initial Consultations, via acceptance of the Consent to Treatment form delivered via email.

2. In cases where confirmation has not been received, CARE LACTATION SUPPORT will reasonably endeavour to contact you to confirm your appointment and obtain pre-appointment documentation.

3. By booking your appointment you are accepting CARE LACTATION SUPPORT’s cancellation and ‘no show’ policy and Fee Schedule as outlined in these Terms and Conditions.

Fee schedule and Payment

1. Please read the Fee Schedule contained on our website or available here.

2. You accept the Fee Schedule as it pertains to the relevant packages and Services you have booked.

3. Payment is expected on or before the day of your appointment.

4. A non-refundable deposit of $50.00 is required for all bookings.

5. Payment for Services can be made via bank transfer, debit or credit card via third party payment systems or via Cliniko. The terms and conditions of Cliniko can be found here.

6. Any fees that are not paid within 7 days of your receipt of the invoice will be forwarded to a debt collection agency. You will be responsible for any costs associated with debt recovery.

Travel Charges

1. All in person consultations will incur a travel charge to and from central Warrnambool. CARE LACTATION SUPPORT calculates the travel charge using the below fees, which will be applied to the distance between central Warrnambool and the location of the consultation.

A. 0-15Km $ 0

B. 15-30Km -$ 25

C. 30km -70km -$ 50

D. Over 50km $75

Cancellation policy (cancellation/late cancellation and ‘no show’)

1. 48 hours’ notice is required to cancel or reschedule your appointment and not incur costs beyond the non-refundable deposit.

2. If you cancel your booking within these 48 hours and do not attempt to reschedule your appointment within 24 hours from your original appointment time, 50% of your appointment fee will be charged.

3. If you cancel within 24 hours of your appointment time and do not attempt to reschedule your appointment within 48 hours of your original appointment, 100% of the appointment fee will be charged.

4. New appointment times are subject to availability.

5. If your appointment is cancelled by CARE LACTATION SUPPORT no financial penalty will be incurred by you.

6. If in the event your appointment is cancelled by CARE LACTATION SUPPORT and no suitable replacement appointment can be arranged in a reasonable timeframe, your full deposit will be refunded.

No Show Policy

1. A “No Show” occurs in the event that CARE LACTATION SUPPORT or one of their representatives arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.

2. In the event of a ‘no show’ all reasonable attempts will be made by CARE LACTATION SUPPORT to contact you and make an alternative appointment.

3. If an alternative appointment is not made within 48 hours of the appointment time, 100% of the appointment fee plus travel costs as outlined in these Terms and Conditions will be charged and no refund given.

Delivery of Services (eg business hours, ongoing support)

1. CARE LACTATION SUPPORT’s business hours are available to view in the patient online management system Cliniko unless otherwise specified. Correspondence, phone calls and support outside of these hours are at the discretion of the Lactation Consultant.

Group Discount for Prenatal Preparation for Breastfeeding Classes

1. CARE LACTATION SUPPORT offers a discount to couples who wish to book the Prenatal Preparation for Breastfeeding class together. The discount you will receive is dependent upon the amount of people attending the class.

2. The discount is calculated as follows:

a. For two couples, each couple will receive a 20% discount on the full fee

b. For three couples, each couple will receive a 30% discount on the full fee

3. In order to receive this discount, you must email us at leanne@carelactation.com.au prior to making your booking.

4. A maximum of three couples (six people in total) are allowed per class and the discount applies to the Prenatal Preparation for Breastfeeding classes only. CARE LACTATION SUPPORT reserves the right to change or limit the number of participants due to COVID-19 restrictions.

5. All participants must be fully vaccinated. CARE LACTATION SUPPORT reserves the right to decline providing the Service to you if proof of vaccination from each participant cannot be provided.

Vouchers

1. CARE LACTATION SUPPORT may from time to time give away vouchers to be used as credit for packages or Services. All vouchers must be used within the time specified on the voucher.

2. Any voucher provided by CARE LACTATION SUPPORT is non-refundable and cannot be exchanged for cash.

3. CARE LACTATION SUPPORT will not be required to refund you for any voucher that was not spent or not used before the expiry date.

Dispute resolution process

1. CARE LACTATION SUPPORT is committed to their clients and their customer satisfaction. If, in the event you are unhappy with the Services provided by CARE LACTATION SUPPORT, you are encouraged to contact us at leanne@carelactation.com.au to discuss your complaint and rectify if appropriate.

2. The code of professional conduct for IBCLCs along with complaint forms, disciplinary procedures and sanction list can be found at https://iblce.org/resources/disciplinary-procedures/.

Limitation of Liability

1. To the extent permitted by law, CARE LACTATION SUPPORT and Leanne O’Connor will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Indemnification

1. You agree to indemnify, defend and hold harmless CARE LACTATION SUPPORT and Leanne O’Connor from any claim or demand, including reasonable legal fees, made by any third party due to, or arising out of, your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Private Health funds

1. If you have private health insurance, you are responsible for liaising directly with your private health fund to determine if you are eligible for private health benefits in respect of the services you receive from CARE LACTATION SUPPORT.

These Terms of Use (“Terms”) govern your use of our Website located at www.carelactation.com.au. These Terms form a binding agreement between you, the user of the Website, and us, Care Lactation Support ABN 38 120 097 318.

By using this Website, you are deemed to have accepted these Terms. These Terms apply to all visitors and users who access and use this Website.
